OUR SERVICES

Our aim with the Adam Health service is to provide high-quality, specialised health care, information and other health services and products focused on men’s health and wellbeing. This includes:
 
·      Remote (phone) and questionnaire based consultations with our healthcare professionals
·      Health tests (provided by a 3rd party laboratory)
·      Medications specific to the treatment of men’s health issues
 
Although our services are delivered by UK registered and fully qualified medical professionals, our service is not suitable for medical emergencies. Also, if you are accessing our services from outside the UK you should check that it is appropriate and lawful for you to do so in your country and/or region.
 
All services are currently only provided in UK English, and you should always seek medical advice in person if you are unsure about your ability to explain an issue to us, or are concerned about any of the advice or information we have provided, or you feel it differs from other advice you have received.
 
All our services are available only to adults and are provided from facilities that are regulated by the Care Quality Commission in the UK (whose website is www.cqc.org.uk).

MEDICATIONS

UK Doctors who are registered with the GMC (General Medical Council) may prescribe medications without meeting patients in person.
 
As part of our service we provide medical consultations based on telephone conversations and online questionnaires you complete (secure messaging and photos assessments may also be used).
 
If we determine based on our medical assessment that you are suitable for treatment we will issue a private prescription, which will incur the cost of the medicine(s) prescribed. The patient is under no obligation to purchase their medicine from any particular pharmacy.

All our doctors have undertaken to comply with the General Medical Council Guidelines on remote prescribing, essential standards of quality and safety as enforced by the Care Quality Commission and copies of these can be found at https://www.gmc-uk.org and http://www.cqc.org.uk.

TEST KITS

The Adam Health website allows you to order medical Tests. This is a service provided by partner laboratories with which we have entered into agreement for delivery of those services.
 
The partner laboratories are separates entities from us and to the extent permitted by law we disclaim any liability for any acts or omissions of a partner laboratory.
 
By ordering any Tests, you agree to comply with any instructions provided in relation to the Tests including in relation to the booking and administration of Tests, receipt and provision of Test materials and samples and payment.
 
The prices will be displayed on the website and you agree to those at the time of placing your Order.
 
We will use reasonable endeavours to procure the processing and despatch of your Test within 3 business days where the Test is in stock;
 
Tests are personal to the person for whom they are intended and therefore may not be returned and no refunds will be given for Tests ordered once the order is placed;
 
We or our partner laboratories may refuse to fulfil an order where we consider the order not to be in the best interests of the person for whom it is intended or who has ordered it or may be illegal or contrary to any regulation or guideline
 
If no one is available to take delivery of the order when delivery is first attempted, there may be a delay in delivery, and/or the recipient may have to follow the procedures of the relevant despatch company in order to collect the order, including picking it up from a depot.
 
Processing time for a returned Test will vary depending on the Test but we will use reasonable endeavours to ensure test results are analysed and sent to you within 14 business days of receipt of your test sample at the lab.  Results will be delivered to you digitally and you explicitly consent to that by placing an Order for a Test via the website.
 
You cannot order Tests outside the United Kingdom.

CHANGES TO ORDERS & TERMS

We may revise the terms of an order from time to time in the following circumstances:
(a) changes in how we accept payment from you; (b) changes in relevant laws and regulatory requirements; (c) changes to the Services which are provided.
 
You may make a change to your booking at any time up to a maximum of 24 Hours before your appointment date by contacting us. Where this results in a change in the total price of the services, we will notify you of the amended price via phone or mobile.

IF THERE IS A PROBLEM WITH THE SERVICE

In the unlikely event that there is any problem with the services provided please contact us and tell us as soon as reasonably possible.

As a consumer, you have legal rights in relation to Services not carried out with reasonable skill and care. If you are based in the UK, advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights.

PRICE AND PAYMENT

The price of the Services will be set out on the website at the time we take your Order. Our prices may change at any time but price changes will not affect Orders that we have confirmed with you.
 
You are responsible for paying the price (Charges) for our services. Some of these prices may include VAT. We will usually charge or invoice you for services at the time you Order. Any amounts charged or invoiced are due and payable upon our invoice being issued unless otherwise specified

CANCELLATIONS AND REFUNDS

Most appointments carry a charge if cancelled by providing short notice. Minimum notice periods may vary, and therefore please refer to your booking confirmation for specific details on any charges that may apply. Subject to the rules below, which impose a charge for any cancellation giving less than 24 hours’ notice, you may cancel your appointment at any time within 7 days of making your booking.
 
You will be charged the full amount if you fail to attend your appointment.
When you book an appointment, payment will be taken from the nominated debit or credit card immediately. Any charges due or to be refunded in regards to a late cancellation or non-attendance will be applied to your nominated card.
 
Subject to the following terms, you have the right to cancel or reschedule your appointment and you can do so by:
 
·      Using the cancellation link in the appointment booking confirmation email
·      By contacting us in a timely manner on support@talktoadam.com

CANCELLATIONS BY US

We may have to cancel an appointment due to an event outside our control or the unavailability of healthcare professional. If we have to cancel your appointment for any reason:
·      We will promptly contact you.
·      If we have to cancel an appointment and you have made any payment in advance, we will refund these amounts to you.
·      Where you have booked a course of appointments, and we have to cancel subsequent appointments, we will refund payments prorate for those appointments which have been cancelled.

Information we may collect from you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). When you visit our Site or correspond with us by phone, e-mail or otherwise you may give us information that would be classed as personal data about you and others you are acting on behalf of. We may collect, use, store and transfer different kinds of personal data about you when you do so which we have grouped together follows:

a. Identity Data which includes your first name, last name, username or similar identifier, marital status, title, date of birth and gender.

b. Contact Data which includes your [billing address,] [delivery address,] [home address,] email address and telephone numbers.

c. Health Data which includes any information about your health including your medical history and/or current health status including but not limited to data regarding test results, diagnoses and medications.

d. Financial Data which includes your bank account and payment card details.

e. Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.

f. Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this Site.

g. Profile Data which includes your username and password for any accounts set up to access our products and services, purchases or orders made by you, feedback responses.
h. Usage Data which includes information about how you use our Site, products and services.

i. Marketing and Communications Data which includes your preferences in receiving marketing from us and our third parties and your communication preferences.

We also collect, use and share aggregated data such as statistical or demographic data for any purpose.  Aggregated data may be derived from your personal data but does not directly or indirectly reveal your identity and so is not personal data in law. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

Except for data about your health, we do not collect any Special Categories of Personal Data (as defined in GDPR) about you.  This includes details about your race or ethnicity, religious or philosophical beliefs, sex life or sexual orientation (unless as part of your health data), political opinions, or trade union membership.  Nor do we collect any information about criminal convictions and offences.

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

It is important that the personal data we hold about you is accurate and current.  Please keep us informed if your personal data changes during your relationship with us.

INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights on the Adam Health website, and in respect of the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
 
We provide you with a limited license to download and access documents from the site, such as these terms and conditions. You may print off one copy and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organization to material posted on our site.
 
You must not modify copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
 
Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.
 
You must not use any part of the materials on our site for commercial purposes without obtaining a license to do so from us or our licensors.
 
If you print off, copy or download any part of our site in breach of these terms and conditions, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

TERMINATION

Your rights to use our website and services will terminate automatically and without notice, if you fail to comply with any of the terms and conditions of this agreement or with other applicable terms, rules or regulations of the Company relating to the use of its site or to the use of any of its services. Upon termination of this agreement, you shall cease all further use of the Company's services and cease to access the site.

LIMITS OF LIABILITY

The Adam Health website allows you to book, amend and cancel services with the Company, and to maintain and update your personal information. The Adam Health has used reasonable care and skill in compiling the content and materials but makes no warranty as to the accuracy of any information and does not accept any liability for errors or omissions contained within the information upon its website.
 
The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, The Adam Health, other members of our group of companies and third parties connected to us hereby expressly exclude:
 
All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity. Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. This does not affect the Adam Health's liability for death or personal injury arising from our negligence, nor the Company's liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

NO MISUSE OR EXPORT OF THE WEBSITE AND MATERIAL

You may not copy, modify, transmit, attempt to unlawfully post content or export any associated content or services. By using our website, you represent and warrant that you are located in a territory where you are permitted to access and use the site without limitation.

VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse the website or materials by introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the site, the server on which our site is stored or any server, computer or database connected to our site or to any of the information which is collected and stored via the site. You must not attack the website in any way.
 
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. The Company will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the website will cease immediately.
The Adam Health will not be liable for any loss or damage caused by a denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, devices, programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

LINKS FROM OUR SITE

Where the Company's website contains links to other sites and resources provided by third parties, these links are provided for your information only. The Adam Health has no control over the contents of those third party sites or resources and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

VARIATIONS

We may revise these terms of use at any time. You are expected to check them from time to time and to take notice of any changes made by the Adam Health, as they are binding on you. Some of the provisions contained in these terms and conditions may also be superseded by provisions or notices published elsewhere within the Adam Health.

JURISDICTION AND APPLICABLE LAW

The English courts will have exclusive jurisdiction over any claim arising from or related to the Adam Health and the services we provide, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms and conditions are governed by English law.
